Welcome to Jake's Custom Carts. These Terms of Service ("Terms") govern your use of jakescustomcarts.com and any purchase you make from us. By using the site or buying a cart from us, you agree to these Terms. If you don't agree, please don't use the site.
1. Who We Are

2. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract to request a quote, place a deposit, or purchase a cart. By using the site, you represent that you meet these requirements.
3. Quotes Are Not Binding Offers
When you submit a quote request through the site, you are asking us for a price estimate. The quote we send you is good-faith estimate based on the information you give us, but it is not a binding offer of sale. A binding contract is formed only when you place a deposit and we confirm the order in writing. Until that point, prices, options, accessory availability, and delivery timelines may change.
4. Pricing, Payment, and Deposits
All prices are in U.S. dollars and reflect cart configurations as built. Sales tax, registration fees (where applicable), and out-of-state shipping charges are additional unless explicitly stated. We accept deposits by credit card, ACH, wire transfer, or financing through one of our partners. Deposits are applied to your final balance and are subject to our Return Policy.
5. Build Time and Delivery
Most carts ship within 1–2 weeks of deposit, though build times vary based on accessory complexity and our queue. We deliver across the state of Florida for a flat $195 shipping fee, which includes drop-off to your driveway. Out-of-state shipping is quoted on a per-order basis. Estimated delivery dates are estimates only — we are not liable for delays caused by suppliers, carriers, or events outside our reasonable control.
6. Financing Partners
We work with a number of independent financing partners — currently including Octane, Dealer Direct, Magwitch, and Synchrony — to offer competitive rates on cart purchases. If you apply for financing through one of these partners, your application is governed entirely by that partner's terms, privacy policy, and credit decisions. Jake's Custom Carts is not a lender, does not make credit decisions, and is not responsible for any approval, denial, rate, or term offered by a partner.
7. Warranty
Every new cart we sell is covered by the manufacturer's standard warranty on the chassis and major components (typically 2–3 years, depending on the brand). Jake's Custom Carts adds a 1-year warranty on the workmanship of any custom installation we perform — including lighting, audio, seats, lift kits, and paint. Wear-and-tear items (tires, batteries, brushes, fuses, light bulbs) are not covered. To make a warranty claim, contact us at the number above and we'll send a mobile technician to inspect.
8. Trade-Ins
We accept trade-ins from customers within the state of Florida. Trade-in values are based on the cart's condition at the time we inspect it, not the photos or description provided in advance. Due to shipping costs, we generally cannot accept trade-ins from outside Florida.
9. Returns
Cart returns are handled on a case-by-case basis under our Return Policy, which is incorporated into these Terms by reference.
10. Acceptable Use of the Website
You agree not to: (a) use the site to violate any law or regulation; (b) attempt to gain unauthorized access to our systems or another user's data; (c) interfere with the operation of the site or its servers; (d) scrape, mirror, or republish our content without permission; or (e) use the site to send spam or harass any person.
11. Intellectual Property
The Jake's Custom Carts name, logo, photographs, copy, and overall site design are owned by Jake's Custom Carts or our licensors and are protected by U.S. copyright and trademark law. You may not copy, modify, distribute, sell, or create derivative works from any of it without our written permission.
12. User Content
If you submit a review, photo, video, or other content to us (whether on the site, by email, or via social media), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and republish that content in our marketing materials and on the site, with attribution where appropriate. You confirm that the content is yours to share and doesn't violate anyone else's rights.
13. Disclaimers
The site and its content are provided as is, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the site will be uninterrupted or error-free, that defects will be corrected, or that the site will be free of viruses. Information about cart specifications and accessories is provided in good faith but may contain errors; final specs are confirmed in your written quote.
14. Limitation of Liability
To the fullest extent permitted by law, Jake's Custom Carts and its officers, employees, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or any cart purchased from us — even if we've been advised of the possibility of such damages. Our total liability for any claim arising under these Terms or your purchase will not exceed the amount you actually paid us for the cart in question. Some states don't allow these limitations, so they may not fully apply to you.
15. Indemnification
You agree to defend and indemnify Jake's Custom Carts against any third-party claim arising from your misuse of the site, your violation of these Terms, or your violation of any law or third-party right.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved between us must be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. The "Updated" date at the top of this page reflects the most recent change. If you continue to use the site after a change is posted, you accept the updated Terms.
18. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and Return Policy, are the complete agreement between you and Jake's Custom Carts about your use of the site and any purchase from us.
